RULE 4001-3

AUTOMATIC STAY - IMPOSING OR EXTENDING

A motion to impose or extend the automatic stay under 11 U.S.C. § 362(c)(3) shall be filed within five (5) days of the filing of the petition. The debtor shall properly serve all interested parties simultaneously with the filing of the motion. Interested parties shall include, but not be limited to, the U.S. Trustee, the case trustee, any co-owner of affected property, and all lien holders of affected property.

2020 Amendment

The amended rule includes only stylistic changes, including amending the title to better parallel the titles of the other local rules applicable to Bankruptcy Rule 4001 and making other clarifications. Note that as of the time of the amendment, Administrative Order 15-002 provides a robust and detailed set of requirements over and above what this Local Rule provides.
