In re: Administrative Order No. 25-002 LOCAL RULE 9070-1(C): EXHIBITS / ORDER ADOPTING INTERIM LOCAL RULE 9070-1(C) (EXHIBITS)

Adoption of interim Local Rule 9070-1(C), set forth below, is necessary to enhance efficient administration of contested matters and adversary proceedings in this Court. The amended rule increases the number of days in which parties shall mark, list, file, and exchange exhibits they plan to introduce into evidence from five (5) to seven (7) calendar days prior to trial or a nonevidentiary hearing. Because the process of formal amendment of Local Rules can be lengthy, in order to implement this change as soon as possible, it is ORDERED: Effective October 1, 2025, Bankr. N.D. Fla. Loc. R. 9070-1(C) is amended and adopted as an interim Local Rule as follows: 2 Exhibit Filing. No later than seven (7) calendar days prior to trial or a non-emergency evidentiary hearing, counsel for the parties and self-represented parties shall mark, list, file, and exchange all exhibits they plan to introduce into evidence. If for some reason the exhibit or a facsimile of the exhibit cannot be filed, clarifying information for the non-filed exhibit is to be provided with the items that are filed. All exhibits must be listed in order on a separate exhibit list, form available online. The time requirements set forth herein shall not apply to exhibits for hearings on Motions for Relief from the Automatic Stay, which shall be governed by Local Rule 4001-1(E). Advisory Committee Notes 2025 Amendment The amended rule includes a substantive change. Subdivision (C) is amended to adjust the time for filing and exchanging exhibit lists from five (5) calendar days to seven (7) calendar days. In addition to increasing the time to resolve exhibit list objections, the Committee believes that moving to a seven-day period will reduce the potentially counterintuitive effect of Bankruptcy Rule 9006(a)(5) and the “next day” rule counting backwards when deadlines are measured before an event.
