In Re: Clerk's Office Electronic Payment Refund Policy / Administrative Order No.: 12-001

In March 2005, the Judicial Conference of the United States approved guidance for the refund of fees paid electronicallly. In accordance with the guidance issued, limited delegation is provided to the Clerk of COurt when it is determined a fee has been erroneously paid. Therefore, IT IS ORDERED that: 1. The Clerk of Court, or his designee, shall be authorized to refund a fee collected electronically if it is determined by the Clerk that the fee has been erroneously paid. 2. Upon verification of the error, the refund shall be processed back to the same credit card from which the erroneous payment was made; and, if applicable, notation of the refund be entered on the case docket. 3. All other refunds will only be considered upon a properly filed motion.
