In re: ADMINISTRATIVE ORDER CONCERNING MULTI-COURT PACER FEE EXEMPTION REQUESTS / Administrative Order No. 20-012 ADMINISTRATIVE ORDER REGARDING MULTI-COURT PUBLIC ACCESS TO COURT ELECTRONIC RECORDS (“PACER”) FEE EXEMPTION APPLICATIONS
From time to time, persons submit requests for waivers of exemption from PACER fees. Such requests are to be approved only if they are limited in scope and intended for scholarly research and not for redistribution on the internet or for commercial purposes. On October 13, 2017 the Administrative Office of the United States Courts (“AO”) published procedures to implement the processing of multi-court PACER fee exemption requests (“Requests”). 1 The procedures require Requests to be submitted to and evaluated by the AO. The AO provides its final evaluation of Requests to the Clerk of Court in each court indicated on the Request form, along with an AO recommended action. Each court will then determine whether to grant, deny, or partially grant the request. In the interest of judicial economy, it is ORDERED: (1)Requests provided to this Court by the AO with a recommendation against approval are automatically deemed denied unless the Court orders otherwise. (2)The Clerk shall notify a requestor whose Request is denied, in writing, of the denial and provide the requestor a copy of this Administrative Order. (3)Once the Court has ruled on a Request, the Clerk will provide the AO and PACER Service Center a copy of this or any other applicable order.
