Filing Agents

For Attorneys, Trustees, and U.S. Trustee Only


ECF Users who are attorneys, trustees, or U. S. Trustees may authorize and designate one or more non-attorney individuals as Filing Agents to e-file on their behalf in CM/ECF.  Having a Filng Agent allows the ECF User and their staff to file and view case information in CM/ECF simultaneously and relieves the ECF User of the need to share their personal login and password. Filings completed by the Filing Agent will appear on the docket as if the ECF User completed the filing.  Filing activity for each Filing Agent may be viewed by the ECF User under Utilities > View Your Transaction Log. 

A Filing Agent’s filing permissions will mirror that of the ECF User with the exception of restricted documents.  Documents restricted from public access, such as Official Form 121 (Statement About Your Social Security Numbers), cannot be filed or viewed by Filing Agents.

 

Instructions for Filing Agents


The Filing Agent must first register for a PACER account as a Non-attorney Filer for CM/ECF.  Once the Filing Agent’s registration is complete, the attorney, trustee, or U. S. Trustee ECF User must add the Filing Agent to their ECF account.  Register for a PACER account at www.pacer.uscourts.gov.  Registration is free.

 

Instructions for ECF User (Attorney, Trustee or U.S. Trustee)


The ECF User is responsible for maintaining their list of authorized filing agents.  ECF Users may add or remove  Filing Agents associated with their ECF account through Utilities > Maintain My ECF Account > More User Information. See detailed instructions below.   The ECF User is also responsible for maintaining and updating their ECF e-mail notification list to add or remove Filing Agent e-mail addresses from the ECF User’s secondary email address list. 

By associating a Filing Agent with your CM/ECF account in our court, you, as the primary ECF User, are agreeing to and are affirming the following:

  • You agree to accept full responsibility for all e-filings by the Filing Agent.
  • You have provided the necessary CM/ECF training to the Filing Agent to ensure the correct filing of cases, documents, and/or pleadings.
  • The Filing Agent has read and is familiar with the Local Rules for the U.S. Bankruptcy Court for the Northern District of Florida.
  • You will immediately remove the association with your account if the Filing Agent leaves your employ or should no longer file on your behalf.

Federal Rule of Civil Procedure 11 and Federal Rule of Bankruptcy Procedure 9011 will apply to documents filed by the Filing Agent.

 

How to Add a Filing Agent to Your CM/ECF Account:


An ECF User must associate a Filing Agent with their account to authorize filing on their behalf.

  1. In CM/ECF, select Utilities > Maintain My ECF Account.  Click on the More User Information button at the bottom of the screen.
  2. Enter the Filing Agent’s last name in the “Find filing agent” field and click the magnifying glass icon to search.
  3. Locate the Filing Agent from the results and click the Select button next to their name.
  4. Click the Return to Account screen button.
  5. If you wish for the Filing Agent to receive Notices of Electronic Filing (NEFs), click the Email Information button at the bottom of the screen.
    1. Add the Filing Agent’s email address to the Secondary email address fields.
    2. Click the Return to Account screen button.
  6. Click the Submit button to save your changes.

 

How to Remove a Filing Agent from Your CM/ECF Account:


When a Filing Agent is no longer authorized to file on the behalf of an ECF User, the association with that User must be removed.

  1. In CM/ECF, select Utilities > Maintain My ECF Account.  Click on the More User Information button at the bottom of the screen.
  2. At the bottom of the More User Information screen, remove the check in the box next to the Filing Agent’s name by clicking one time in the checkbox field.
  3. Click the Return to Account screen button.
  4. Click the Email Information button at the bottom of the screen.
  5. Remove the Filing Agent’s email address from the Secondary email address fields, if applicable.
  6. Click the Return to Account screen button.
  7. Click the Submit button to save your changes.
